A skilled attorney can make the best of weak evidence

Car accidents can happen in a variety of ways, including rear-end collisions, sideswipe and side-impact collisions, rollovers, pile-ups, and head-on crashes. Although some categories of car accidents are statistically more deadly than others, even less serious accidents can lead to significant medical expenses for car accident victims.

Take a car accident that forms the basis for a lawsuit filed in Raleigh at the end of October. That accident was, according to the complaint, caused by a truck driver who attempted to pass a vehicle on the left side going north but had to pull back due to a vehicle in the oncoming southbound lane. In the process of pulling back into the northbound lane, the trucker swerved and struck the victim’s vehicle, causing him injuries that ultimately resulted in over $32,000 in medical expenses. 

As we've pointed out in recent posts, drivers in West Virginia are able to sue at fault parties for damages they sustain in motor vehicle accidents, unlike drivers in states where no-fault rules are in effect. One of the challenges, of course, in pursuing negligence claims for car accident injuries, is proving negligence. In some cases, it isn't always clear. Cases involving allegations of unsafe passing and accidents of a similar caliber are not necessarily a slam dunk for plaintiffs, depending on the specific circumstances of the case.

Presenting a strong case for negligence, of course, is important and the ability to do so ultimately depends on the evidence available in each particular case. No attorney, regardless of how skilled and experienced, is able to squeeze good evidence for negligence out of a rock.
