Looking at comparative negligence in West Virginia

Determining who is at fault in a motor vehicle accident is not always a straightforward task in personal injury litigation. This is particularly the case when there are multiple parties who contributed to the occurrence of an accident. Fortunately, the law is sophisticated enough that it has the ability to account for the fault of multiple parties, and even the relative fault of the plaintiff.

In our previous post, we began speaking about the Compliance Safety Accountability program, overseen by Federal Motor Carrier Safety Administration, noting that changes have been proposed to the program. A bill recently introduced in the House of Representatives would specifically change the public nature of the program’s safety ratings.

Proposal would make changes to trucking safety program

Truck safety, as we frequently point out on this blog, is an important issue in highway safety. Federal and state regulations are continually working to address the issue and improve regulations and oversight so as to decrease the frequency of truck accidents and increase accountability for trucking companies who don’t follow safety rules.

ATV safety an important issue as weather warms up

All terrain vehicles are a common form of transportation here in West Virginia, both for work and play. As readers know, though, ATVs accidents can and do happen and these can lead to serious injuries or even death. The laws governing ATV use are fairly liberal compared to the laws governing motor vehicle use, but it is obviously still important for those using ATVs to exercise reasonable care, both for their own sake and for the sake of others.

Speed limits impact truck safety for more than one reason

One interesting fact in the trucking industry is that the tires used on nearly all large trucks are designed to withstand no more than 75 miles per hour on a routine basis. Tires do exist which are able to withstand greater speeds, but most trucking companies use standard wheels. This point is actually significant in terms of trucking safety because right now there are a total of 14 states which have speed limits at or above 75 miles per hour.
