West Virginia bicyclist injured in car accident

This blog spends a lot of time talking about the tragic consequences of serious West Virginia car accidents. These are instances where significant damages can be suffered and liability should be sought to be imposed. But, there is another type of accident that can result in a deadly outcome: a car-bicycle accident.

Many West Virginians ride bikes. Some ride as a mode of relaxation, while others utilize it as a cheap mode of transportation. Though motorists should share the road with bikers, many fail to do so, whether out of spite, inattentiveness or some other form of negligence. This is what happened recently in one West Virginia accident, where a man was left with serious injuries.

The crash occurred in the early morning hours on a busy highway. According to police, the bicyclist was returning home from work when a passing car hit him. It is unclear at this time if the bicyclist was in a lane meant only for cars, but the driver of the vehicle claims to have not seen the victim until it was too late. The bicyclist was taken to the hospital where he is in critical condition, and the investigation is ongoing. The driver of the car has not been charged.

With a case like this it is important to remember that civil cases have a lower burden of proof. Therefore, even though an individual is not convicted of a crime, or even charged, he or she may still be found liable for damages in a civil lawsuit. When it comes to a car-bicycle accident, victims may have significant losses, including medical expenses and lost wages. However, by working with a dedicated attorney, a victim may be able to recover from the negligent driver who left them with serious injuries.
